      Hi everyone

      Just a query if anyone has any input it could be helpful

      I have read that some compensation payments have been made to victims and so called victims.

      I have also read that in some cases these have been made even before the case has gone to court or the alleged has been charged.

      Does anyone know when these payments are made / how you apply? for these payments / and if I am correct they could be made before a conviction or charge ?

        I believe that compensation payments are offered sometimes regardless of whether a case proceeds to court, in fact when reading through old threads on here a lady was told that her rapist would not be standing trial and yet she was encouraged to apply for compensation, which she was very upset by.

        It is the kind of information that is very difficult to come by and can only be requested by your solicitor if you are charged and when your defence statement is submitted as far as I am aware.

          and last paragraph from rapecrisis website:

          "Compensation can sometimes be awarded even if the abuser was not successfully prosecuted. Monetary compensation cannot undo the effects of rape and sexual assault, however it can be viewed as a form of justice and a way of society acknowledging what happened - whether the abuser is punished or not."

            Its quite frightening that people would get payouts without a conviction or even a charge !!!!

            I have read on these forums that specialised counselling should be the way forward.......however in genuine cases where people have lost work etc I fully back compensation payouts but a blanket amount depending on circumstances seems crazy......

            Its like if you loose a finger in a work related accident you would receive £xxx or a leg £xxx

            Just throwing this one out there if anyone could shed some light please........ Lets say someone receives compensation for an alleged rape and the person accused does not go to trial..... if this "victim" has or is declaring banckruptancy would the compensation be taken into account ? or would it not be considered in terms of recouping part of the money the person has gone bankrupt for ???

            I guess they would not consider taking any of the money paid out.....but thought I would ask the question.

            Also in my situation, the Police have recently spoke to my ex wife. We were divorced about a year ago. She said they asked really strange questions but did not tell her what the accusation was. My FA had tried on a few occasions to stir things with my ex wife via texts and phone calls....... this was to the point my ex wife blocked her number. My ex said she did not paint me in a wonderful light but did tell police she was never hit or sexually abused in anyway and that she totally trusted me with my children.

            She asked me what I was arrested for and when I told her she just shook her head and pretty much said she didn't believe the accusation and thought my FA was a nutter.

            I wanted to tell her incase the worst happens and I am charged and she finds out from someone else.
            Police told her they wouldn't need to speak to her again ???? This was a phonecall interview.......is this usuall ?? My ex wife live about an hour drive from the OIC station.

              Wow

              Hi everyone

              So.........went down to Wales to see my kids on Saturday and was going to pop into Police station on way home to answer my first bail........ scheduled today 1pm ( not in Wales )

              Had an answer phone message on Saturday AM from solicitor saying I do not need attend......... good news in one way but thought " here we go another 3 month of not knowing etc etc "

              So although I had paid for the hotel I just wanted to go home back to North East.
              Had amazing time with kids and good chat with ex wife who is fully supporting me. ( she had dealings with my FA and thinks she a psycho )

              Anyway......back home last night feeling a bit down.......

              As I had already booked day off work I thought I would make most of it and have a chill day

              Then woken up this morning at 9am by my phone ringing.......did not answer or look at it

              When I did look at it I realised it was a call made from the area I was accused due to the area code and a message had been left.

              Listened to the message which was off Solicitor and heard the magic words NO FURTHER ACTION

              Emotional wreck don't come close......... so many things going through my head........best one was telling my Mother who has been a rock and I know what this been doing to her.........

                Brilliant news for you and quite right too, this is a case which should not even got past the front desk, but unfortunately post-Jimmy Saville the police have been directed to initially always believe those making the allegations.

                        So bit of an update
                        I have letter from my solicitor dated 13.10.14 saying "As you know you were due to answer police bail on above date as part of an ongoing investigation. However we are pleased to inform you that the police have decided to take no further action against you"
                        Phone call conversation with sol confirmed NFA
                        Message to call OIC left on answer phone to contact them.
                        She said I am pleased to inform you that the CPS have decided to not pursue the allogation as when my phone was examined for deleted texts they undermined her lies.
                        Had a nice xmas coz thought this had been sorted
                        OMG might have even had my life in the hands of these muppets had this crock of lies gone to court

                        All the best everyone and my heart goes out to everyone living the worst nightmare imaginable
