    So, im new here and have no idea what im actually looking for. ill just get down to the details.

    I was falsely accused of raping to ex-parteners over 12 months ago, the accusations supposedly happened during a consential sexual and normal relationship, there was never a time where either of us did not consent to sexual inter course, in either of the relationships.

    Starting with the first relationship and the first false accusation of rape, there was no issues during the relationship and we hardly ever argued, the main reason we argued is about my smoking habbits (no illegal drugs just tobbacco) my ex-partner wanted me to quit and i wasnt ready.

    As the relationship went on I was finding hard to cope with not being able to smoke while spending time with her, which was a lot of the time as I lived with her in her parents house for near on nine months. We was consentially sexually active and we decided we had reached the point of taking our relationship to the next level and we was trying for a child.

    During this period my ex-partner became distant and acted as though she was not interested in me, as the attempts at forming a family were not successful, We began to argue more about menial things, like not doing the washing up straight away or that i went to see my own family while she was off galavanting with one of her male buddies, where she ignored my calls or texts (i now know she was cheating on me with this other lad). As i was not the type of guy to end a relationship i stuck it out, then there was a big argument about me being snappy because of the cold turkey sittuation which ended the whole relationship, with a loving sentence "F*** off and never come back" which i done just that. i hadn't been in contact with her for 3 to 4 years and i had never planned on being involved in anything that was related to my ex-partner, the oneday i get a knock at my door from the ploice wanting to arrest me for allegations of rape.

    I complied with the officers ad i was in shock that this was happening, i didnt know what to do, I answered all there questions to the best of my knowledge with the upmost truth, I would never lie to an authorative figure where it the police or just someone oldder than myself. I was released on bail for a month.

    This leads on to the second ex-partner.

    The second ex-partner was as i thought a down to earth girl who would never make up such lies to get someone in trouble, but then i guess jealousy can be a deamon sometimes, again we rarely argued, she didn't care that I smoked tobacco and that I spent time with my family, as she believed that family are just as important as friends. The only time we argued were when i recieved a text or my phone made a noise, she was very controlling and as I later learnt a liar, we spent a lot of time together, i got on well with her parents and had a good laugh with them in general.

    On chistmas ever was the first time we moved our relationship to a consentiall sexual status, and from then on we had regular intercourse, when ever i stayed at her parents house with them we was allowed to stay in the same room and everything that happened was always consented to by my ex-partner, in most of the instances she was the person that started the intercourse with foreplay. as the relationship went on and we passed our first anniversary she sugested to me we try something nre... this was my second sexual partner so i was willing to learn something new and exciting, when she suggested "bondage" i never thought anything of it and went along with it,

    it all went to pot when i lost my job and started talking to a ex-online-partner she started accusing me daily of cheaating on her and that i was more interested in spending time with someone 100 miles away or someone who lived in wales.

    My ex-partner went to India for one of these adventure holidays with her sister and father (this is where the jealous rage comes into it), when she was out there i had planned to go to south wales to look after a old friends child while they went to court to fight for the custody of their child. but as i was un able to travel i couldn't go.

    my ex-partner came back to england and found out about this and believed i went to south wales and slept with the person (which i didnt and had no intentions of it), however, i was talking to my ex-online-partner from 5 years previous who still have feelings for me and me for her,

    my at the time current partner found out about this and lost the plot, i ended the relationship shortly after as she became over-obsessed with this and controlling in ways that no one should experience. back to the false allegations, i had no idea at the point of the end of the second relation ship that i would then late on be accused of such crimes. 3-4 years after the first and 1-2 years after the second relationship i was arrested originaly as mentioned before,

    i attended bail a month after the original arrest date where i was re-cautioned on for a new, out of the blue allegation against me from the second partner. i was questioned about this and gave the same asnwer as i did in the previous questioning for the other allegation.

    I stated that the relaionship was always consential and when asked about the "Bondage" i stated that it was her idea and that is was consential from both her and myself.

    I have had a duty solicitor with me from the beginning of the allegations i though at the beginning they were a god send, now however, i feel that they are not being as helpful as they could be, they have given no advice on what will be happening, as they "do not have the papers"

    i have looked for another solicitor that specialises in such cases and have found one, when i went to my duty solicitor they pretty much refused to return the legal aid forms as they had "already sent them of to the court"

    my first hearing ons the coming wednesday if i keep my duty solicitor for that will i be able to change solicitors after that hearing if i feel that they are not helping as much as they could be or do i have to stay with them throughout the case? any advice on the hole situation would also be appreciated, i have been going through a lot of stress and have developed health problems because of this and that has also led to me being dismissed from my employement.

    Hi and welcome to the forum,

    I have not changed anything in your post but have split it into paragraphs.

    One of our members is very experienced in legal matters (and especially in the matter of changing solicitors) and she finds reading a large block of text difficult.

    As your first hearing is this coming Wednesday time is of the essence. (is this the Magistrates Court hearing where the case will be sent to Crown Court or have you already appeared there?)

      One inconsequential thought on re-reading your post:

      Did you never have a home of your own where you lived with either of your ex's? If not and you lived with them both at their parent's houses is this where the rapes are alleged to have occurred?

      If so the jury is going to be perplexed as to why either of the women did not seek assistance at the time of the allegations are supposed to have happened from their parents

        Thanks for the paragraphs CH

        Years ago, if a def was not confident in the solicitor and barrister they had, they were usually able to transfer the legal aid over to a fresh solicitor. These days it is almost impossible. Somebody on here attempted to change their representation and although the previous sols were actually willing to let the case go to the fresh sols, the judge refused the transfer.

        If you can afford to pay privately you might be able to change. However, you would get NO reimbursement if you are found not guilty given you are eligible for legal aid.

        Are either of the complainants on Facebook or similar? If they are and you have an account, can you check to see if their profiles are open so you can maybe obtain helpful evidence from there?

        2nd question - do the two complainants know each other? Are they 'friends' on Facebook?

        CH has a point about being in the parent's home, but of course it's possible that the parents were not in all the time

          Have u kept any card from the relationships, any thing u have that can help u do not show the police or cps as they will allow them to change there storys time date and were it happend, did u tell the police ur 2nd fa name in interview?

            Not a problem CH i do have issues with paragraphing, im dyslexic so im shocked i managed to make that understandable lol

            The hearing on wednesday is the one at the magistrates court so this is where they will be sending it to the crown court if the judge sees fit to do so.

              so would that mean that if i feel my current sol is not doing there best with the case i would nto be able to change them after the first hearing if it goes further? I have looked at many different sols inthe area and in the UK.

              I cant afford a private sol but if i have to i will find the funds to do so, I am giving my current sol a chance as i am unsure of how they will act within the court as i have never been in the situation of needing one. is there a way to actually find out if the sol company i am using are any good and what there rating is on such cases?

              At the begining they didnt know each other, but after the second break up they seemed to have started talking to each other and from what i can make of all of this they have planned it between them. As the day all of this happened they defriended/blocked all of my "friends" and family on facebook. they are friends on facebook as since the start of the allegations i have not been on facebook as i was advised not to. but mutural "friends" have told me that there has been some sort of conversations between them relating to myself or the case. (i have quoted friends" as none of these people talk to me since the 4th bail date)

              and RF and CH we never have owned a place of our own and to be honest we were never actually olone in their parents house, if there parents were out either some of their friends or siblings was in the property.so there was always someone else with us.

                I have not kept anything from these relationships, im not the sort of person to keep a memory box or anything from past relationships that have ended in arguments. I didnt have to say the names of any of the FAs during the interviews.

                      Soz just re read Your op very, very strange that when you go back on ur bail date they come up with another one, somfin does not make sense there, fink some 1 needs to have a look at there fb just makesure it ain't you!!!

                          There not on that i could see, but i have asked if anyone has dealt with them, maybe peopel might have, hope so i dont wanna pile the last of my trust in to them and be popped on if you know what i mean?

                            So have u been charged, as u say u have court Wednesday, if what they call themselves were friendsdont talk to now then they we're never friends, hope u have some surrport fromur family

                              Hi Sorry to hear about your current situation, I just wanted to mention that it is possible for your solicitor to request any Facebook communication (including private conversations), texts or other social media contact between the two accusers when your defence statement is submitted before the plea hearing.

                              I know this as our solicitor requested this info regarding my daughter and her friend who she had persuaded to lie for her regarding disclosure of abuse and who was going to be a prosecution witness.
