    I've sat through too many trials and appeals to pretend that British Justice is anything but about winning. I've seen some very dirty tricks pulled by the OIC and prosecuting barristers.

    Recently I attended a trial in Northampton where the prosecuting barrister was truly dreadful - as a person as well as the strokes she pulled. I found out she defends as well as prosecutes. If she defends in the same way she prosecutes then there will be many guilty people walking around when they should be in prison.

    Another guy I know was in prison when the police tried to stitch him up with a download of child porn that they KNEW had been downloaded by his stepson. They knew that because the stepson had admitted it to them. I found the handwritten notes of the interview in the 'unused bundle' after the trial. It had been put there after the trial deliberately, so that defence wouldn't see that they had tried to stitch our man up.

    All he knew was that he was accused of the download and suddenly he was not charged and it 'went away'. Of course it went away - the download occurred while he was in prison and he had the perfect alibi. Plus of course the confession of the stepson - WHO WASN'T PROSECUTED......

I can sort of recognise that I'm doing a good job of carrying on as normal but it does help immensely when someone says it to me like you have. It hurts so much when I see my fabulous children playing so happily and secure in their environment but they are oblivious that one person is so enormous in the power to destroy their lives.
      Awww didn't want to make you cry lovey!! That is my biggest fear too....my children knew my partner had been accused thanks to village gossip but they like most people who are not directly involved have forgotten about it and things have returned to normal (for them at least) I just hope if my partner ends up being charged they don't hate me for not having made them more aware of what could happen...a waiting game and a bit of a gamble.

        With regards to the 'disclosure' trickling through - your defence team should be robust in insisting on evidence being disclosed to the defence, that undermines the prosecution case (known as 'the unused bundle/material').

        I know that solicitor Chris and Tania QC will go so far as to insist on a pre-trial review (PTR) to ask the judge to order the evidence to be disclosed to defence if the CPS are being awkward (or 'not ready!') Any good defence team worth their salt should do this

        What is really important apart from the unused is something called the CRIS - Crime Reporting (or Recording) Information System. This should contain the record of the 'investigation' minute by minute. Often what you find on there differs to what the police actually put in their statements / say to each other updating at every point.

        Often this will include people they have spoken to but then not bothered taking statements from. The police don't like to part with the CRIS report very often, as they know that if the investigation has not been properly undertaken it will probably show on there.
