  • Falsely accused by a 17 year old

    Hi,

I ahve been reading this forum for about week or so and would like to thank all of you who are providing support without any charge. I have been falsely accused of rape, I'm currently on bail and wondering if someone could (Rights fighter) help me out as I'm trying to find a solicitor who're specialised in defending FA. I'm in South on the border of Hampshire.

I really appreciate help from all of you. This forum has been a very valuable support (even more than my family support) I was having thoughts of commiting suicide within first week after my arrest and then I started browsing the internet and came on to this site and I have to say that I had read such a valuable information on this site, I can't explain how much I appreciate your help guys.

    Many thanks

I've got two solicitors in mind but don't know whether they'd be able to take me on public funding (or partly public / private) basis.

    http://www.ebrattridge.com (Garry Mcdonald)
and chris saltrese are the one I have seen quite a lot on this forum, I nearly considered Stephen Cooper but then I searched this site and came up with threads about him and I'm staying away from him as far as I could.

    Many thanks guys

It depends on whether you are eligible for funding. If you are not then I would suggest Chris Saltrese as he works nationally.

You say that you are on the border of Hampshire. Hampshire and where?

Hi there, really glad you found the site and that you are getting a lot from it at this horrible time for you. There is a lot of knowledge about, and empathy for you in your situation.

In order to offer more help, an outline of what you have been accused of and what you think could be the motivation behind this False Accusation would mean more specific help and advice can be given. No names or anything, no exact location and no really gory details though!

Please don't worry about expressing your feelings - all of us here have either been there, or have supported a loved one through this ghastly experience.

        Good wishes to you
        Jen

          Dear Rights Fighter,

How do I know whether I'm allowed public funding or not...? I'm a British citizen if that helps. or do I have to be on the benefits or something like that...? I currently earn around 500 to 600 quid a month in my wages. I'm on border of Dorset and Hampshire, I don't mind if I have to travel to see any solicitor in surrounding counties.

I have seen Chris's website and have read quite a few reviews about him but one of the forum post I saw mentioning that it would cost 50k max if privately funded. and I have to say I don't have that sort of money spare. I haven't got my own house yet, I am just an ordinary guy who is having a lot of trouble with my current life and this(allegation) was added bonus on top of all my life problems.

Everyday I wake up thinking about this and go to sleep doing the same as well. I have lost so much weight because I don't each much as the stress of all this is killing me.

I really apprecaite all of you guys who're helping peolple like myself without any financial benefit, to name a few, rights fighter, faith, denise, casehardened, etc.

You can pay by instalments. I am not sure of sols in our area but it seems we may not be too far away from each other.

I'll add you to my contact list and you should soon be able to PM me your whereabouts.

Thanks RF, your help is much appreciated. I have a question, how long does the network providers keep the text messages as a backup...? as my phone has been taken away and plods are taking too long and I'm wondering if they loose my phone which has all the text messages. would I be able to request it from the network provider like after a year or whenever they finish their investigation...?

              Many thanks guys

                Hi and welcome
Sorry you're another statistic that has found yourself in this situation :-)
But as you know this is the best place for info & support

I found the forum helped me sometimes more than family and by coming Here it meant I wasn't bending others ears as I was becoming Di Denise

You need to give members a little more (brief) info about your situation

On your income you'd be eligible for public funding I'm sure but maybe you could google that
                Xx
I live in hope it's over forever

                    Hi and welcome
You will find lots of helpful advice as I am sure you already have. I too viewed the forum for a week or so before plucking up the courage to post. I can empathise with the ‘low’ period you found yourself in and I hope by joining the forum you have found some strength to fight this.

Even if they were deleted they should still be on your phone or memory card - a forensic expert should be able to retrieve them.

Going direct to the phone company would likely prove fruitless...they would only give that kind of information to someone in authority like the police so a forensics expert is definitely the way to go, as RF says.

Just want to offer a belated welcome. Not an easy place to be in, but you will find some fantastic support here.

                            Hi and welcome.

A forensics expert is only going to be of use if there is a phone to physically examine...........................

Do you feel that the phone will provide you with evidence to discount the allegation?

It is very early days yet. You could get a NFA (No Further Action) or NC (No Crime) within a couple of days or it could be months/years.

Even a trial is a long way off.

Where you are at the moment is not a nice place. Everything is fresh in your mind and the Police will no doubt have treated you like a psychotic serial killer. You will be emotionally exhausted.

Suicide is NOT the answer. It's a consideration and one that crossed my mind also. Everything seems to overwhelm you. You'll find yourself viewing people in a different light, avoiding situations where you are alone with others and generally withdrawing from life. Being falsely accused is disgusting and the torment on the mind is overpowering.

You can fight back and you're already on the right path. Knowledge is power! Being here and reading others posts is a damned good start! The more informed you become the better you will be able to deal with your situation. The Police/Government don't help with their complete lack of info for those accused of a crime.

Finding a solicitor is a good start but there isn't a great hurry as there is little they can do at the moment. It is however worth having one on standby who can work away gathering information from the Police/Crown as it becomes available (assuming England is the same as Scotland of course!).

Focusing on the phone may cloud your exploration of other avenues that could ultimately lead to compelling evidence in your favour... I'm not saying don't focus on the phone but just don't count on it.

At the moment I would try and de-stress before you make yourself ill. Go out and do some sports or indulge in your hobby for a while just to get your mind of things. If your concentration is failing you then maybe just get a deck chair and lie in the sun/go for a country walk.

Unfortunately I cannot recommend a solicitor in your neck of the woods. I have no doubt that someone else can and they may appear shortly. Obviously Rights Fighter will give very valuable info/recommendations as the force is strong in her and her knowledge is outstanding.

                            Relax. De-stress. Head up. SMILE!.
                            Wow... A signature option!

thanks lawlessone2009, I appreciate your time and helpful words. Unfortunately its easily said than done, and I'm finding extremely difficult to be happy at the moment. This is on my mind first thing when I wake up and till I go to bed at night. All day I'm worrying to death about this. I just want this over and done with.

I have spoke to couple of solicitors @ mary monsoon and they have said they'll only be able to help once police /cps deliver their verdict. I have been bailed twice.

I'm wondering how long does the DNA forensic results take to come back...?
on the google it says it can be back within a week or so. in my case its been over six months and no news yet.

once again thanks guys for your help
