  • My husband has been falsely accused

    Im so worried my husband has been charged with rape. Everyone who knows him well cannot believe it. We were hoping it would be dropped but it hasn't ,he is being taken to court in the few months. I'm not sure what I can say on here.

    As long as you don't give any identifying information (or graphic) then you can post anything. If we had some detail to work on then we can all advise as appropriate.

      Hello and welcome. I'm sorry you had to find us.
      We are a highly supportive community and everyone here has been affected by a false allegation, either directly or indirectly.
      If you can, try to post a few general details about the situation. Nothing that will identify you - no personal details, names or place names apart from the county in which you live.
      You are right to be cautious about what you post and no-one here will encourage you to reveal personal details. However it is helpful if you can give us an outline of the case...for example, is the allegation historic or current; does it involve multiple complainants or a single accuser; did your hubby have consensual sex with the complainant, etc etc.
      Have a read through some of the posts here and you will get the general idea! As long as your hubby is genuinely innocent we will do all we can to help. For now, just a few questions which will help us:

      Has your hubby been formally charged, or has he been arrested and questioned pending further enquiries by Plod?
      Has your hubby been released on bail or remanded?
      Do you have a solicitor on board?

        Thank you for your advice.
        My husband has been charged and awaiting trial he has been bailed . The accusation was made last aug nearly nine weeks after she said he had raped her. She said it had happened the night she and her husband stayed over at our home, she stayed in the small bedroom next to ours and her husband slept on the sofa downstairs, my mother was in the other bedroom next to ours. Myself and my husband were in our room all night.

          Does your husband have a specialist solicitor?This is of the utmost importance.
          Do the police have a statement to confirm your husband was in bed with you all night?

          Often these cases can proceed on one word versus the other.
          When your husband gets a disclosure through, you will see a bigger picture.

          Are these people friends of yours. Or should I say were they, obviously they won't be now. Does the accuser have any known motive for making this allegation. Is she aware that she would be entitled to compensation?

          Thanks for sharing anything that you feel comfortable with. it's not an easy situation but you will find some incredibly supportive people here.

            I have given a statement telling them that my husband was in bed all night with me, which he was I'm a light sleeper and always hear him get up. You can hear throw the wall if anyone is in there, like talking moving around in the bed ext. yes to the question about compention she and her husband would know about that as they have been to court before. The barrister has had other cases of rape she does defence work and also prosecution , but what I can find out about her not much, she seems to win more prosecution cases than defence but that may not be accurate. The woman was raped before years ago when she was a teenager well that is what she tells everyone when she is drunk, she has told me many times the last was the night she stayed over.

                How do you know you have a specialised solicitor, they say they undertake serious crimes eg manslaughter , rape ext. as well as driving offences and such like.

                  Maybe you could put up your area and someone on here could recommend someone they had used.
                  I'm not in England but I know when we went to get legal advice I struggled to find someone who was specialised and ended up going to one who was a criminal solicitor.
                  Hopefully someone will be able to help you.

                      Does anyone understand hoe DNA works, for instance does all 11 components have to be there , eg there was 11 of hers and only 3 of his but I had washed the item months before the alleged allegation so what I don't understand is how come some of his is missing probably caused from when I washed months before but she has all of hers on it . Also there 2 other DNA on it to but don't know who they belong to

                        DNA is easily cross contaminated - recent cases have pointed this out. Can I ask what the DNA was on and who would have access to whatever it was on?

                          There have been many recent reports of DNA evidence being wrongly used. It is not as conclusive as sometimes people think.

                            Combination: reccommendations from others, your own faith in them after talking to them, their website, their past cases, news coverage, reviews...

                              I am not asking you to scan and paste up the DNA report from the Crown expert on here.

                              I am asking you - who is the expert for the Crown and which organisation do they work for? One or two have been discredited in the last couple of years. If they were involved in your case there may be an argument for an abuse of process to get the matter stopped (or stayed).

                              If you are not happy or at all confident with your defence I suggest you contact Nunn Rickard of Exeter, if you cannot afford to pay privately. If you can afford to go private (around £50K max) as Faith has suggested, you can contact Chris Saltrese who is experienced in these matters.
