hi, just a quick answer on your question based on our experience. Your solicitor will explain clearly to you the possible number of years you can expect if things go wrong. As far as I can remember, age of the accuser when the "assault" happened is a great factor. I hope you have a good solicitor that will guide you well in the process and provide you with all the information you needed.

We only found out about the possible years after our first hearing at the crown court, maybe the solicitor will set another meeting with you to formally give you all the information you need.

Be strong for your trial tomorrow! Am sure some more senior members of the forum will be here to give their comments. :-)

Complainants are usually given every assistance they need which can include being allowed to look at their statements in order to "refresh their memory". Obviously this courtesy does not extend to the defendant.

I am interested in the "specialist doctor" you refer to. What sort of "specialist?"

            sexual assault

since the complainant was always in and out of the hospital due to illnessess.the prosecutor lawyer suspected that her client suffered frm recalling some incident. i suspect they get a psyciatrist doctor.bec her lawyer said they want to find out if she really capable of giving reasonable evidence.

A case I was recently involved with was stopped before it actually started because the Crown had to concede that she could not give reliable evidence to the point that if she ever makes a complaints of sexual assault again she will not be believed. Sad as this could be a case of crying wolf.....

If your accuser really does have a mental health disorder I can't see that you could bring about a successful prosecution as the allegations she made against you would probably not be considered malicious, due to her illness. Further it would be up to the police and Crown to make the decision. If you attempt to prosecute her privately especially under these circumstances (should she be considered to be mentally ill), you could find yourself paying out thousands of pounds with no good result.
