    Hi Guys,

    Thanks for taking the time to read this. A few months ago i was travelling home from work. I stopped at a station went to a shop and returned. I stood by the door for 4/5 minutes while waiting to see if work were going to call. When they didnt i proceeded to get on the escalator. I had my works phone and a wallet in my hand. Towards the top my phone slipped and with a jerk forward action grabbed it but in the process of doing this i brushed against the leg of the lady in front of me. She then freaked out saying i had tried to take a photograph up her skirt. I explained it was a work phone and it didnt have a camera. I went with her to staff at station then police. I explained to them it was a works phone. She then said i had "touched" her between the legs. I was arrested and interviewed. Once they had the cctv i was interviewed again. I felt i was harshly treated in the interview with cctv and although it showed no touch my I phone was seized and checked for photo's. It all came back clear. The case was sent to the CPS then came back i was being charged on 1 count of sexual assault. Im going out of my mind with worry as in her statement she accused me of "touching" her 12 inches up from the inside of her knee. I did brush against her but it was more calf/back of knee area. Im due at Magistrates court in a few weeks to enter a plea. Can people advise me on what to expect and costs etc as my solicitor said im unlikely to be entitled to legal aid and if found guilty may have a tag and curfew etc. Please guys i know it may sound minor but im so sick all the time thinking about this. Thanks.

        I'd try and fine a solicitor that specialises in these charges - the one you have doesn't sound very good.

        I'm not sure why they were checking for photos on your phone if there was no camera on it. If the CCTV shows there was no touching where they implied there was it all sounds rather feeble.

        If you were to be found guilty then it will have far reaching effects on your life. They will already have your DNA, fingerprints and photos and you'll also appear on the Register.

          I had an i phone too. But was not in my hand at the time of the incident. As for solicitor i have been doing re-search and she has a decent record. She couldnt speak while i was being interviewed and was shocked when the CPS said they were charging me. It does sound feeble to me too but the evidence wont be released until i enter my plea. With it being such a silly thing if i am found guilty of something i didnt do what are likely outcomes. She said i may get a tag, community service and a fine.

            not so sure about a tag - they don't normally let SO's have them - I may stand corrected on that.

              Thanks. That's some bit of a relief to me. Just wish the sick feeling will go. I'm also interested to see why the cps decided to charge me with no actual evidence.

                Why couldn't she speak while you were being interviewed? Solicitors advise their clients by speaking to them during the course of the interview.....

                  Well maybe I was bring naive in thinking she couldn't. I was told by the interviewing officer that I could stop the interview at any time to speak to her. But it was all straightforward I didn't need to. I'm just concerned by the thought of doing time or any other punishment for that matter if I'm found guilty. I can't understand why I was charged when there is no evidence. They had the CCTV which didn't show anything. I went to the police with her, then she changed her statement when she saw it was my works phone and not an I phone in my hand. Plus the ridiculous accusation of a touch 12 inches up from her knee. My head is a mess and I constantly feel sick thinking about having to go to court now.

                    Also..is it a bit strange that my sol takes days to reply to my e mails..just wondering as i e mailed my sol last wednesday and i have still not heard anything back as yet..

                        Yes. That's true. Just being inpatient with it being my 1st dealings with anything like this.

                          unfortnatly these things do happen iam in the middle of my case from what i have learnt from the great people on here is that there is support from people with many diffrent cases and backgrounds. if it can be seen on cctv that you dropped your phone iam sure that will help. i would also be pretty sure that you will get bail inbeetween any court cases just like me you have a long way to go (if it goes all the way ) keep strong

                            Thanks. Unfortunatly the CCTV in inconclusive as it shows nothing really. I was charged on her 1st statement. Got told the costs I have to pay today just for the trial etc and it's quite ridiculous. I'm on unconditional bail now as I obviously have attended all things that have been asked of me. I'm due to court Tuesday to enter a plea. Yes the folk on here have been great so far. I will need more input later as to costs and charges etc. Mine seen pretty high. But then again I'm not sure what they should be. I'll post some bits later and hopefully I can get advice. Hope all works out well for you and your husband. Thanks for reading and replying.                               if its of any help your first court apearance is pretty simple in hubbys case he was just asked to confirm his adress and how he pleads he was then given a return date for commital to crown you will also receive a copy of the accusers statement are you taking a sol with you
