  • So worried

Hi im new to the site.
About 2 days ago virtually the same thing happened to me even down to the act happening in a car park. The girl and I parted on what i considdered good circumstances, I even texted her in the morning to check she got home ok and to try and arrange another meeting. Later that day i got arrested and held for 24 Hrs while they interviewed me. ive currently been released on bail till oct. Im so worried as to what will happen. I just dont feel that i did anything wrong she was asking me to do everything that happened and it was her who initially approached me! but how can my word against hers be proved. Im hoping that CCTV will have shown us holding hands and being friendly beforehand. Im also worried as they took my clothes which were dirty due to being on muddy ground and me falling over on the way home. I would love any advice that anyone can give as im going out of my mind at the moment.

    Hi billykickass,

Write doen everything that happened immediately - no detail is too trivial - even about the sex itself. Did anyone see her leave? CCTV? anything to show she did not look traumatised? Have you a good - not duty - solicitor?

Don't worry, we have all been there or know somone close to us to has been there.

This will take a while, and preparation is everthing.

Hi Billy, maybe start a new thread so more people will be able to give advice more easily just to you. Best wishes to you. Jen.

          Hi thanks.
Ive already pretty much given every detail in my initial statement think lots of people saw her leave and should be on several cctv cameras on leaving the nightclub. so far I have only used the duty solicitor as it was all so new to me i felt like it didnt know what was going on, ive never even been arrested before. Ive been trying to get hold of the taxi driver that brought me home afterwards to show that i wasnt in any sort of trauma and had no injuries. the thing is where it happened was right near lots of houses she could have screamed out at any point if i was raping her and everything we did was consensual she was telling me to do things if anything she was pushing herself onto me the whole night but how do you prove that? im also in the army if that has any influence. sorry its all a bit erratic im just so worried i have a beautiful girlfriend who i have really let down and somehow through the grace of god she is still with me and we have a great home and life together that im so afraid of losing please if anyone could just give me a ray of hope i know i did wrong but i certainly did not rape anyone! The duty solicitor seemed to think that they had hinted that it would be NFA'd but then said they were waiting on a medical report something to do with 'severe injuries' i have no idea what that could be. sorry again im just hoping somehow this can be ok thankyou for any help or advice.

Just tried to organise a 'non duty' solicitor and was told that unless i get charged i have to keep dealing through the duty soilicitor.

I am not sure that you have been advised correctly. At this stage it should be pretty straightforward to change sols - it's only later in the process that it becomes difficult. Talk to a new sol - they should be able to approach the "duty" sols and ask for a transfer.
I am not an expert, so please do check.

                    Chris saltrese solicitors?

Anyone know much about this company Chris saltrese solicitors? says they specialise was gonna give them a ring.
Also spoke to taxi driver that picked me up after aleged event and he says he will right a letter saying that i did not have any injuries or was in a state of distress when he picked me up i hope this can have some effect. also i went to car park where it happened hoping that cctv would have seen the whole thing and cleared my name but unfortunately no cameras im gutted that could have cleared me. Im still so worried just wish i could have something to crack a smile about and start giving my girlfriend back the love and attention she deserves I was a total idiot on one drunken night and wish i could take it all back just so i can give my girlfriend the life she deserves.

Chris Saltrese is one of the best sols you could ask for. Unfortunately he is up North and can't take on Publicly Funded (the old Legal Aid) cases, unless they are appeals. This is because of the way Publicy Funded cases are...well...funded.
However he may be able to recommend a sol nearer to you.

Just spoke to them they said its a standard fee of £35000 plus VAT. which i would gladly pay to clear my name as they said that if it gets dropped you get the money back. DOes anyone know how you would have to pay as i dont think i could pay that in a one off do they offer longer term payments?

                              Should I read into it?

After my interview with the police the arresting officer said to me that hopefully this can be put to bed before i go back to work (in a couple of days)
Also the duty solicitor said a sgt at police station hinted that it would probably get NFA'd. However he also said that they were waiting on a medical report something to do with 'severe injuries' of which i have no idea could be as i certainly didnt have any injuries like showing a struggle or anything surely i would be cut to hell if trying to hold down a woman to rape her. Also he said that would be unusual as they should have had the report before interviewing me. I only had one interview also. Sorry to be a pain but as you can imagine im trying to hold onto anything that looks like hope. Also the taxi driver that picked me up said he will write a letter saying that i had no injuries and was not in a state of trauma or anything.
