  • Never Ending Questions

    Hello everybody,

Im just wondering about a few things really. My partner has recently been charged on 6counts of rape. 5 from when he was in a relationship with this girl and one from last year when they had consensual (vaginal) intercourse. The 5 charges throughout there relationship are claimed to ve vaginal. The one from last year is regarding the anus.

On first interview my partner completely denied this. Now we have spoke he says they had consulensual anal sex as she suggested it. I worry about him changing his statement so late on, he says it was due to females being present throughout his case and him being embarrassed and ashamed as he didnt want me (his girlfriend at the time) too find out.

He appeared at magistrates yesterday and read a brief summary of his charges. His ex girlfriend has 4 friends as 'witnesses'. Basically saying she confided in them about the previous rapes! Her mother is also a witness and her ex partner (who is now in jail) who she called the morning after the anal accusation. His mother also went the morning after as he was out partying and couldnt get there asap.

What are the benefits/descripenses in changing his statement now he has been charged?
    How viable are these witnesses?
Can someone who is in prison for 8years who has also had a false allegation against him be a reliable witness against my partner??

    Regards a lost lonely lady

[I've combined your two threads as they both related to the same question and deleted the posts that are now irrelevant]

These are really questions for a solicitor and I have no idea about the last two, but i would think, regarding the first one, that a good solicitor will be able to bring out a reasonable and sensible justification for the change of statement at trial. He won't be the first - or last - man embarrassed to talk about intimate matters in front of strange women, even if they are police officers. There are worse things he could have done I'm sure, but again his own solicitor is the best person to advise on all these questions.

A question for the solicitor ASAP, get it sorted and straight. Thing is the CPS are ruthless and will/maybe exploit this and use it against him. If an alleged victim changes her mind its because they was scared/in shock and they are also allowed to say its vague I don't really remember, and basically lie. But when we the falsely accused make changes or can't remember its becuase we are being deceptive/lieing apparently.

This sounds a very complex case and a specialist solicitor would be the best legal support. However also expensive support. Try siting down with your partner and discussing how he can present his case for feeling too embarrased. Then record this discussion and future discussions you and your partner have relating to the overall case.
Also discuss and record why you think they have made these allegations.
The purpose of doing this will help you feel more in control of the situation and more able to consider the facts, without the emotional fears clouding your mind.
This is just a small contribution, from me as I am the wife of a really decent man who has also been falsley accused of rape----also a family scam--hoping to get compensation.I have been managing for two years and its very tough but I am a fighter and I am fighting still.
You are not alone and you do need help emotional as well as practical, so please get some legal help as son as posible.

There are many specialist solicitors out there who work on legal aid. It doesn't have to cost a penny.

There are also many charlatans out there who pretend to be specialists in false allegations but in fact are basically only interested in relieving you of your money, prior to Charge and/or afterwards. Some are private client solicitors and come claim to be private investigators or "legal enquiry agents". Folk need to be extremely careful and do their homework before signing contracts or paying over any money.

Most NFAs or NG verdicts in the support groups tend to be via legal aid representation.
