I can imagine you are extremely worried especially as you have no idea what you are going to be questioned about, but you have done absolutely the right thing in contacting a solicitor.

I imagine that your solicitor has already offered to accompany you to the police station and sit in on the interview, if not please ask them to or, at the worst, request a duty solicitor. Don't fall into the trap of assuming that as you are innocent you have no need of a solicitor (at this stage it is not necessary for them to be specialists in defending false sexual allegations.

Be guided by the solicitor (you must request a pre-interview private consultation after the solicitor has had any disclosure about the allegation) as whether to respond to questioning or to go 'no comment' but don't fall into the other trap of saying too much. Answer questions concisely and honestly without expanding or volunteering information. If you have a cast-iron alibi or other defence to the allegation please request another private consultation with the solicitor to discuss this before mentioning it to the interviewer (they will re-interview the person making the allegation who may then change their statement to suit!)

I think the most likely outcome is that you will be bailed for further enquiries to take place in which case this link will make useful reading:

As you have not been arrested it is unlikely that your phone and PC will be seized for examination (unless something comes up in the interview which makes this a desirable course of action) but it is worth bearing in mind as a possibility if you need them for work

I'm extremely nervous as there is a suing culture at the
Moment within people working in the media industry and although quite a few people's accusations have come true it's worrying really.

As the police officers have invited me in by appointment my solicitor has arranged to come Along with me.

I'm also having to arrange close Body protection and a car to take me as my agent thinks That I'm going to have a media frenzie when I'm going inside.

I do need my phones as there my only contact with the work I do and I have some quite personal phone numbers Init and unsure weather they will have a look at them ?

But like I said the police as of yet are being quite about the allegation as of yet I don't know who's made it hoping to find out shortly.

Has anyone els had anything similar

If the police thought there was likely to be any corroboration of the accusations on your phones they would have already seized them by means of a doorstepping visit.

However, if say, during questioning you mentioned that a text or message stored on your phone confirmed what you were stating, it is then possible that they might want it in order to download this as evidence to present to the CPS.

with you mentioning you was in care for many years, if the allegations are from when you was 14 years or younger and depending on the year, then Doli incapax might apply to your case.

also if for example if the allegation is from a old girlfriend perhaps say you was both 15 and it was before a certain year (there is a post on the forum that explains this in full) and you both consented at the time to sex, then based on what I read then the other person can only make a complaint something like upto 12 months, other wise they are out of time..... Unless of course they are saying they did not consent.


Doli incapax , basically means incapable of guilt, between the ages of 10-14 years old the CPS would have to rebutt it. subject to the year of the allegation.

my points my not be valid, but if you can give a year from when these allegations are from and your age at the time, then my points might be valid for your situation.

Just had to get a new phone as the police have taken it from me.

Upon meeting with the police they have said that the allegation from 2011 when I was in a relationship
With one of my ex's the person was originally consenting to sex but during asked me to stop.

Upon speaking to my solicitor who is very high (partner) swithin the uk's number 1 listed solicitors She advised to me to talk within the interview but when stupid questions where asked she flipped basically and said do not answer anything more.

They have seised my phone on the grounds that I have allegedly been sending messages to the person
Obviously I don't mind my phone being taken as this will prove my innocence further.

My solicitor applied to the high court for a press ban on the grounds there no evidence to support the person allegations and it would be career destroying for me although I have noticed little articles that a person in similar situations as me being arrested at the same time etc in the news.

I am now on police bail for 4weeks hopefully this will all disappear
