  • My situation

    Hello all

I found this website and forum after carrying out a google search on falsely accused of rape. I have recently been accused of this Offence, of which I am innocent.

The incident occurred last week at a conference, I was approached by a 'colleague' of sorts and she asked for my number and began messaging me, within the first few messages she had asked for my room number (I did not give this). The messages continued and a group of us went to a local bar, I invited the colleague along and she came (I think she arrived before my group as we was there before I arrived). We were talking for quite a bit and she was getting to know me quite well, she left before the bar closed and asked what I was doing, I replied that I was staying until it closed. We said bye and she went back to the hotel but we continued to message one another. She had said she wished she'd have stayed and I said she was silly to have gone then. This led to her inviting me back to her hotel room, which I did and we had consensual sex (admitted by my accuser) instigated by her.
The next day we had another conference, we did not talk to each and she was talking to other guys, so I assumed she had 'moved on' quickly and thought nothing of it. Then on Tuesday I received a call from the police asking to speak to me about an incident - I was very confused. I was advised to get a solicitor which shook me up a lot - i figured it would be about the girl I had met the week before. I had an interview under caution - I had prepared notes and my sol had advised to use them as an aid memoir when needed (the police had agreed to this). I gave my version of events and then was given brief info from the police about what my accuser had said (a lot of stuff made up) - I was so upset and confused. Why had she done this?!
I passed on the messages we had exchanged to each other (she said there was only a few but even my sol was surprised by how many I had on my phone). We also asked the police to get CCTV from the bar that night (my sol has contacted them himself to request the footage) as a few things didn't add up from her statement. Atm it is left as reported under investigation.

I am terrified - I have a young son and a partner (obviously silly of me to have cheated on her, I know). I have told my workplace and thought I was going to be sacked, they have been helpful and didn't sack me.

Could anyone give advice - if I'm arrested later on, will my workplace be able to sack me (even if released on bail immediately)? I only began working there beginning of September.

My sol said he got the impression that this isn't going anywhere but I don't know what to think or feel. I've been granted counselling by my workplace but I feel depressed already and so upset as to why someone would do this to me. My life could be ruined for doing nothing wrong, I'm so scared.

Any help and advice would be greatly appreciated, I can provide further info if needed but wasn't sure how much I could put (and apologies if I have put too much).

    Thanks in advance everyone.

    Hi Dazed and Confused
Sorry to here what you are currently going through. You are very unlikely to be arrested later, your initial contact with police was by phone and you co-operated by attending interview. If they need to speak to you again it will probably be a similar scenario, police don't like to make extra work for themselves by going out to arrest people who have already been compliant and attended interview.

It is good that you still have the messages you exchanged with her, if you haven't already done so write a detailed time line of events whilst it is still fresh in your mind. Maybe the accuser needed to explain her infidelity to a partner and made up the rape claim, or maybe she felt rejected the following day that you didn't pay her more attention. There are so many reasons that false allegations are made, just concentrate on setting down the true version of events and DO NOT share with police until you have consulted with your solicitor.

It is unfortunately a waiting game, these investigations are rarely concluded quickly and may take some months.

    Best Wishes

    FS
The truth is like a lion. You don't have to defend it. Let it loose. It will defend itself.

Hi, this was admitted to the police in her interview, she said that it then turned in to rape (and some other unsavoury untruths).

        Thank you frightened spouse.

So does she claim that she asked you to stop once you had started? Is that the allegation? Also you appear to say that you were not arrested but interviewed under caution.

Good that your place of work is at the moment being helpful.

Sounds like a case of "regretted sex".

            Hi

Yes that is essentially what was said (with other bits thrown in e.g. Attempted anal sex - my sol told me before the interview that this might come up as it is a tactic used by FA's as it sounds much worse!!!).

The police asked why I thought this had come up and I said maybe she regretted it afterwards. Workplace have been good, my sol said I'd probably have grounds if they were to sack me at this moment in time. What if it goes to court though - can they sack me/is it likely they'll sack me then??

I would think that might depend on whether you work with vulnerable people.

Hi, could I ask what you mean by positives?? Not being funny just trying to clarify!

I sent the messages to my sol who forwarded on to the oic, thank you.

I don't work with vulnerable people in my role, my workplace have limited it to on a need to know basis to preserve my reputation and that of my workplace.

Is there any further advice on what to expect next/what I should do??

Oh I see, yes it's very bizarre. But don't know what to do or where to go from here. I can barely sleep or eat atm. I know it's early days but I'm just so shell shocked. I cry or try to hold back tears most of the time and nearly had a panic attack on Friday. Meanwhile she is posting messages on a professional online forum (can't name which one) as if everything is normal. I just can't get my head round all of this
