  • falsely accused of rape for the 2nd time same person pls help

    Can some one give me some advice please, I have been in a violent relationship with my girlfriend for 7 yrs, throughout the last five she has continuously beat me some time severely needing hospital treatment then she rings the police and reports that she has been abused, I have 25 arrested for domestic violence and although i have never been charged either due to her retracting the statement or my injuries have made her claim laughable and been nfa'd off,

    early on this year she accused me of oral rape, let me explain briefly , the action took place with her total consent and was in fact her that initiated the oral sex on me, a few hours later my girlfriend became very angry about something petty in the house and began beating me quite badly for about 20 minutes inc kicking me down a flight of stairs, when a neighbor told her she was calling the police on her for this she immediately rang 999 and made the false allegation of rape, I spent 20 something hours in custody and had to give some very personal samples etc, I was bailed and returned to my home,
    as per usual my girlfriend retracted the statement some time later.......
    My girlfriend and I got back together and again the beatings started , leading to eventually last weekend.
    we both had a few drinks and went to bed after we had sex she became annoyed at some petty **** in the house again, ( just an excuse to start a row ) she beat me again quite severely and when i threatened to call the police on her she rang 999 and reported that i had again raped beat and stole from her, again and more importantly told the police that i had forced her to retract her first allegation.
    i spent some 20hrs in the police cells again undergoing the intimate tests and questions and again bailed.

    My girlfriend has now only a few days later decided that she wants me back and retract her statement but is scared that she will be prosecuted so intends on telling the police that she was "confused" but she will not admit that I have never raped beat or stole of her.......

    Although this may once again get me out of this predicament, I do have proof via social media chats txt messages etc that the first allegation and the second were both false by her own admittance.

    What should I do ?
    should i give this evidence to the police and let them decide what to with her ?
    Would this remove any mark against my name with the police ?
    I don't want her to go to prison but she does not seem bothered if I do ?
    Would she be liable for prosecution ?
    If found guilty would prison be likely for her?

    Sorry you are here. There must be some well documented incidents of domestic violence against you and maybe your neighbour can help too.

    From a legal standpoint I think better experienced people will be along with good advice.

    Keep everything though, screen shots of social media, keep the texts anything and everything. There is quite a distance between allegation and sentence and it sounds as though there is plenty to cause doubt.

    However, I want to be blunt. You are in a toxic relationship that is always going to put you in physical danger and now in danger of false allegations. My advice is the same as I would give to my girl friends, get out of this situation and enjoy life. You deserve better.

      I can't help with the legal side to much but from my personal experience, which was similar to yours in some respects, no violence but I too went back to my girlfriend after she made an allegation only for her to do it to me a second time. What I learnt was that it doesn't matter how much you love this person, people like that are self absorbed and don't care about you. You need to get out of this abusive relationship before its too late and you could end up in prison or worse.

      The best thing you can do is take that evidence to the police via your solicitor as they will know how to present that in your best interests legally as the police seem to not care to much about the truth and just want convictions, and then get as far away from her as possible and never look back.

      I'm sorry that you have had to go through this ordeal as I and many people on this forum know just how damaging this kind of allegation can be to a person and that's without the physical abuse to boot. I hope you can get yourself away from this mess and find someone who treats you like a human being.
