    Hi

    I will be attending a court hearing in 3 weeks for a plea hearing.

    My defence team has received disclosure.

    It shows nothing but unclear stills of a person that is meant to be me and unclear CCTV footage of a person walking on the same route as a female.

    The CCTV goes out shot and a girl alleges she was attacked on her doorstep several mintues later.

    It seems the case is about food that was alleged was mine [because a takeaway guy says he saw me and I bought the exact food only 20mins before] and the fact that the female said and picked me out. She alleges that she had a conversation with me but there is not evidence of this.

    My case of attempted rape changed to touch without consent by the Police/CPS after 4 months and I was charged when answering my bail.

    No DNA etc was ever brought up in the Police interviews after 2 months.

    There is no DNA reports or Scene Of Crime Report even though we keep requesting this. It's been nearly 3 weeks.

    This has been going on for nearly 9 months.

    Any views?

    Hi Rik,

    I'm not sure what to say that hasn't been said to you already. It all looks very 'thin' - don't you think?

    It will be interesting to know what is (or isn't ) on that forensic report if it ever comes to light.

      Hi Thanks for the reply.

      I guess when you have never been in a situation like this its all so confusing and scary.

      I dont know how to gage anything coz im in the situation.

        I know, it's incredible confusing and scary, sorry if I sound impatient. Try and stand back from it all if you can. Do you think you could forbid yourself to think about it for a couple of days just by keeping yourself occupied or entertained? Start learning a musical instrument, that'll keep your head busy!

        That's what you really need do try and do, then you should be able to look at things objectively. Btw - Did you know this girl? Do you know what her motives could be?

        Without knowing this, from where I'm sitting they haven't got anything solid enough to convict you on ( forget charging because they seem to do that routinely). Some of the material they've come up with, a discerning jury will think 'What the ....is this all about? ' , just as I'm thinking right now.

        You have to get your defence ready - that is prove that you did not , would not and could not have done what you're being accused of however baffling or ridiculous it might seem. You would prepare for a boxing match or a marathon run or an exam, wouldn't you?

            Attended Crown Court today - horrible

            Hi all

            My case has been given a trial date next year. Pleaded not guilty.

            We did not receive and DNA or forensics and this doesnt seem to exist.

            We have continually asked for the alleged food at the scene but non was provided for the plea hearing.

            The judge has now ordered whatever the so called food that was meant to have been found to be disclosed. 21 days has been given.

            It is not clear about the availability of my accuser and the takeaway man.

            Question is whether the food is mine and proof it actually exists.

            Any thoughts as I am very scared.

              when did she go to the police was it that night or the next day? what have you been charged with? sorry I haven't been following your thread

                She didnt call the police some random drunk stranger went into her garden and got into an argument with the house members and he called the police.

                It was attempted rape but changed to touch without permission. They are trying to place me in her garden based on some food. But no DNA or proof of food has ever been disclosured for 9 months.

                The case makes note of an "identification" issue.

                  so a drunk stranger went and rang the police (what did he ring them about) were you picked out of a line up? what evidence have they put forward, is it just her statement?

                    Only evidence is her statement and the statement of a takeaway alleging that he served me that nite. A receipt total for food but at a different price to what was ordered. My description is completely wrong.

                    However, both picked me out of a line up.

                    Girl described me differently to what I look like but picked me out. I live in the area.

                    The food is to place me in her garden.

                    Dont know what the guy rang about but he said he saw a white guy around the area but I am mixed race.

                      how long have they to put in all there evidence in, because then your defence team can start to work on it. did the takeaway bloke see you with the girl?

                        All evidence has been given. The only things never bought up was DNA or what food if any.

                        Judge has ordered what food is meant to have been found and what proof it was mine. 21 days to provide evidence. no evidence was provided for over 9 months.

                          well if they aint got food in 21 days it should all be ok I would think don't hold me to it, do you know the girl at all?

                            Hi Rik.. even if they find the food, and it's established you were in the garden... it still doesn't PROVE you unlawfully touched her. I'm sure judge's don't like having to deal with half-baked stories like this one.

                              I will hold out the 21 days and see what evidence of food is meant to exist and what makes it mine.
